The updated UNDP Legal Framework for Addressing Non‑Compliance with UN Standards of Conduct introduces several substantive changes: (1) The authorities and responsibilities of key actors have been refined to reflect current practice or changes in the investigative process; (2) To strengthen whistle‑blower protection and safeguards against retaliation, subjects of investigations will now receive the investigation report at the time charges of misconduct are issued; (3) The Legal Framework also clarifies the rights and responsibilities of investigation subjects and further defines the role of investigators; (4) Provisions on administrative leave have been updated to reflect current practice and to clarify the evidentiary threshold for placing staff members on administrative leave without pay; (5) Disciplinary proceedings have been revised as a result of the changes in investigative procedures; (6) New provisions have been added regarding the organization’s recovery for loss of property or assets, and to reflect current procedures for the placement of subjects in the ClearCheck database; (7) Finally, the updated Legal Framework provides additional clarity on the effects of implementing the disciplinary measure of demotion, the provisions on protection against retaliation, and the policy’s scope of application.

The UNDP Legal Framework for Addressing Non-Compliance with UN Standards of Conduct has been updated to reflect the following changes: (1) Deleting the reference to Resident Coordinators; (2) Updating the name of BMS/OLS and BMS/OHR; (3) Expanding the existing requirement to inform victims of harassment to include victims of sexual exploitation and abuse; (4) Clarifying the general obligation to report allegations of misconduct; (5) Clarifying that where the subject has separated from service after being charged with misconduct but before the imposition of a disciplinary sanction, BMS/OLS may include the matter without the subject’s response to the charges if the subject fails to provide their response within the deadline.

The Legal Framework was revised to incorporate developments and lessons learned from the practice of handling allegations of misconduct. Changes regard: (1) the means to expedite the handling of such allegations; (2) the roles and responsibilities of different members of senior management in the process; (3) clarifications on anticipated timeframes for staff; (4) clarifications on application of certain disciplinary sanctions and non-disciplinary measures; (5) action taken and decision-taking authority at each stage of an investigation and/or disciplinary proceedings when a staff member may separate, and (6) updated links and information about various resources available to staff members in matters concerning allegations of misconduct.
